OSHA’s General Duty Clause is commonly diluted to this synopsis: The OSHA general duty clause, Section 5(a)(1) of the Occupational Safety and Health Act, requires that each employer furnish to each of its employees a workplace that is free from recognized hazards that are causing or likely to cause death or serious physical harm.

The word for word text, which gives explicit clarity, reads:

SEC. 5. Duties

(a) Each employer —

(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

(2) shall comply with occupational safety and health standards promulgated under this Act.

(b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct.

This last section (b) indicates why it is so important to Engage, Educate, Equip, and Empower all of your employees to be able to manage their own safe work practices. Once these components are in place, employers must Expect and Evaluate the employees’ compliance with the employers’ policies.
